Early Bird Launch Membership Terms (Web Version)

By purchasing an Early Bird Membership (“Membership”)—Essential, Performance, or Elite—you agree to these Terms.

1) Start & Activation

  • Sharpened opens on January 5, 2026.Your Membership activates on the date you book or attend your first session after that opening date.

  • From activation, your Membership runs for three (3) consecutive 30-day billing cycles (≈90 days).

  • Activation should occur within 30 days of opening (by February 4, 2026), unless otherwise approved by Sharpened.

2) Term & Commitment

  • Minimum 3-month commitment from activation.

  • Membership ends automatically at the conclusion of the 3-month term unless renewed.

3) Payment Options & Authorization

  • Choose Pay in Full (upfront) for all 3 months or Monthly Billing (every 30 days from activation).

  • If Monthly Billing is chosen, you authorize Sharpened (and its payment processor) to charge your saved payment method automatically every 30 days from activation through the end of the commitment.

  • Keep a valid payment method on file. Failed payments may result in suspension until resolved.

4) Session Usage & Rollover

  • Sessions must be used within each 30-day billing cycle.

  • Unused sessions do not roll over.

  • In limited, documented circumstances (e.g., illness, emergency, travel), Sharpened may grant a case-by-case rollover or credit at its sole discretion. Requests must be made before the cycle ends.

5) Scheduling, Cancellations & No-Shows

  • Book through Sharpened’s system or staff.

  • 24-hour notice required to cancel or reschedule; late cancellations or no-shows are deducted from your sessions.

  • Class times/instructor availability may change.

6) Refunds & Early Termination

  • All payments are non-refundable.

  • Early termination may be considered only for documented medical reasons or verified relocation outside the Las Vegas area; approval is at Sharpened’s discretion and may require reasonable documentation.

7) Studio Cancellations (“Make-Good”)

  • If Sharpened cancels a session for reasons within our control, we’ll credit or reschedule that session within the current billing cycle or offer a reasonable alternative.

8) House Rules & Safety

  • Follow posted rules and staff directions for safety and courtesy. Sharpened may suspend or terminate access for unsafe or disruptive conduct.

9) Health Acknowledgment

  • You confirm you’re able to participate and will disclose relevant health conditions. Sharpened may require medical clearance for certain activities. Stop if unwell and inform staff immediately.

10) Service-Specific Disclaimers

  • Nutrition Coaching: educational; not medical diagnosis or treatment.

  • Bodywork/Massage: results vary; certain conditions contraindicated; clearance may be required.

  • Peptide Consultations: informational/referral only; any prescriptions are by licensed clinicians.

11) Liability Waiver

  • You understand fitness, yoga, and wellness services involve inherent risks. You assume all risks and release Sharpened, its owners, staff, and affiliates from claims arising from participation, to the maximum extent permitted by law.

12) Media (Photo/Video)

  • We may capture photos/video for marketing. To opt out, notify us in writing before participation; we’ll tag your profile and strive to avoid capture.

13) Privacy & Communications

  • We use your contact info for confirmations, reminders, and updates. We do not sell your data. You may opt out of marketing messages while still receiving essential transactional messages.

14) Force Majeure

  • Sharpened isn’t liable for delay, rescheduling, or failure to perform due to causes beyond our reasonable control (including outages, government orders, extreme weather, or similar events). Services resume as soon as practicable.

15) Dispute Terms & General Provisions

  • Governing law: Nevada; venue: Clark County, Nevada, unless both parties agree otherwise.

  • If any part is unenforceable, the rest remains in effect (severability).

  • Failure to enforce is not a waiver.

  • This is the entire agreement; changes must be in writing.
    E-signature/Click-wrap: Clicking “I Agree” (or completing purchase) is your electronic signature and acceptance of these Terms. We record your Agreement Date/time, IP, and terms version with your order.
